Terms of sale

These terms apply when you buy from Martinez Wines online, by phone or for collection from one of our shops. Please read them before you order: by placing an order you accept them. Nothing in them affects your legal rights as a consumer.
1. Who we are
You can contact us by email, by phone, or in any of our shops in Ilkley, Bingley and Haworth.

2. You must be 18 or over
- We don't sell alcohol to anyone under 18. By placing an order you confirm that you're 18 or over.
- Whoever collects or receives an order must be 18 or over. If they look under 25, we or our courier may ask for photo ID (a passport, photocard driving licence or PASS card). If no-one aged 18 or over can show it, we won't hand the order over, and it's treated as an uncollected order or failed delivery (sections 6 to 8).
3. Your order
- When you place an order online, Worldpay takes payment straight away. You'll see your order reference on screen, and Worldpay emails you a receipt.
- Our contract with you starts when we accept your order, which is when payment is taken. If we then find we can't supply it, for example because an item has sold out, there's a pricing mistake or we can't deliver to your address, we'll contact you, and you can change the order or cancel it for a full refund.
- Please check your order before you pay. If something's wrong, contact us as soon as possible.
4. Prices and payment
- Prices are in pounds sterling and include VAT (at 20%, or the reduced rate where it applies). Delivery charges are shown in your basket before you pay.
- You pay by debit or credit card on Worldpay's secure payment page. We never see or store your card details.
- If we find a mistake in the price of something you've ordered, we'll contact you: you can go ahead at the correct price or cancel for a full refund. We won't supply goods at a price we know to be wrong.
- We may change prices and offers at any time, but not for an order we've already accepted.
5. Discounts and offers
- Case discounts and multi-buy offers apply to orders collected from our shops, as they do when you shop in person. Delivered orders are charged at the full price.
- Case discount: 5% off qualifying wine when your order has 6 or more bottles of wine, or 10% off when the order also comes to £150 or more before discounts.
- Wine marked “No further discount”, or already in a multi-buy offer, counts towards the 6 bottles but isn't discounted again. Multi-buy offers apply to complete sets only; extra bottles are at the normal price.
- Your basket shows exactly which discounts apply before you pay.
6. Collection from our shops
- Collection is free. Choose the shop in your basket, which shows how soon each shop usually has orders ready.
- We’ll email you to confirm when your order is ready to collect. Please don't come to collect until you've heard from us, and bring your order reference.
- If you haven't collected your order within 3 days of our email and haven't been in touch, we may cancel it and refund you, less a restocking charge of 5% of the order value.
7. Local delivery
- Local delivery is free, for orders of £65 or more, to addresses with a postcode starting with: BD2, BD8, BD9, BD10, BD13, BD15, BD16, BD17, BD18, BD20, BD21, BD22, BD23 1, BD23 2, LS16 9, LS19, LS20, LS21, LS28 5, LS29. We may not be able to reach every address in those postcodes; if we can't deliver to yours, we'll tell you and offer collection or a refund.
- We deliver within 5 working days of your order and will contact you to arrange a time.
- Someone aged 18 or over must receive the order and sign for it.
- If we can't deliver after two attempts, we may cancel the order and refund you, less a restocking charge of 5% of the order value.
8. National delivery
- National delivery costs £12.99, or £8.99 on orders over £65.
- We deliver to mainland England, Wales and Scotland. We can't deliver to the Scottish Highlands and Islands, the Isles of Scilly, Northern Ireland, the Isle of Man, the Channel Islands or outside the UK; checkout checks your postcode. Please call us if you'd like to discuss another address.
- We aim to hand your order to our courier within 3 working days. Someone aged 18 or over must receive it and sign for it.
- The courier will try to deliver twice. After that, please arrange delivery with them. If the order comes back to us, we'll contact you: we can send it again for a further delivery charge, or refund the goods.
9. Gift vouchers
- Martinez gift vouchers can be spent in any of our shops in Ilkley, Bingley and Haworth. They can't be used to pay online.
- They don't expire, and they can't be exchanged for cash.
- If you collect your order from one of our shops, your gift vouchers are ready with it (we'll email to say when). With local or national delivery, or if you order only gift vouchers and ask us to post them, we post them separately, free of charge, to the card holder's address, usually within 3 working days.
- Gift vouchers don't count towards delivery charges, the local delivery minimum or discount thresholds.
10. Availability, vintages and alternatives
- We keep stock levels on the site as up to date as we can, but they can change quickly.
- Vintages change. If the wine or vintage you ordered isn't available, we'll contact you before sending anything else: you can choose a suitable alternative or a refund for that item. We won't substitute without your agreement.
11. Changing your mind: your right to cancel
For orders placed online or by phone, including orders for collection, you can cancel within 14 days of the day you (or someone you choose) receive the goods, without giving a reason. This doesn't apply to purchases made in person in our shops.
- To cancel, tell us clearly by email, by phone or in writing. You can use the form below, but you don't have to.
- Returning the goods: bring them to any of our shops, or send them to our Ilkley shop, within 14 days of telling us. Unless the goods are faulty, you pay the cost of sending them back.
- Your refund covers the price of the goods and the standard delivery charge you paid, within 14 days of us receiving the goods back (or evidence that you've sent them), to the card you paid with.
- Opened bottles: we can reduce a refund for any loss in value caused by handling the goods more than you'd need to in a shop. An opened bottle of wine can't be resold, so opened bottles aren't refunded unless they're faulty (section 12).

12. Faulty or damaged goods
By law, what we sell must be as described, fit for purpose and of satisfactory quality. If it isn't, you're entitled to a refund if you tell us within 30 days of receiving it, or otherwise to a replacement or refund.
- Broken in delivery: goods are our responsibility until they reach you. Please tell us as soon as you can, ideally within 5 days and with a photo, so we can claim from the courier. We'll replace or refund the goods.
- Corked or otherwise faulty wine: tell us, and bring or send the bottle back with most of the wine still in it so we can check it and claim from the supplier. We'll replace it or refund you, and we'll arrange collection at our cost if you can't bring it in.
- A wine that isn't to your taste isn't faulty; see section 11 for unopened bottles.
13. Refunds
We refund to the card you paid with, within 14 days of agreeing the refund. Your bank may take a few more days to show it.
14. Our responsibility to you
- If we break these terms or are negligent, we're responsible for loss or damage you suffer that is a foreseeable result. We're not responsible for loss or damage that isn't foreseeable.
- We don't exclude or limit our liability where it would be unlawful to do so, including for death or personal injury caused by our negligence, for fraud, or for your legal rights in relation to the goods.
- We sell to consumers for private use. If you're buying for a business, please ask us about our trade terms.
15. Complaints and the law
- If something's gone wrong, please contact us first and we'll do our best to put it right.
- These terms are governed by the law of England and Wales. You can bring proceedings in the courts of England and Wales, or, if you live in Scotland or Northern Ireland, in the courts where you live.
- We may update these terms from time to time. The version on this page when you placed your order applies to that order.
